Welcome to ToBeTheLight. The terms “we”, “us” and “our” refer to ToBeTheLight.
This online store is operated by ToBeTheLight, trading name of a sole proprietorship registered in Poland.

These Terms of Service (“Terms”) define the rules for using our online store and the conditions of sale of products offered through the website https://tobethelight.eu (the “Store”).
The Store is operated in accordance with Polish law and European Union consumer protection regulations. The Store is intended exclusively for Consumers.
By using the Store, placing an order or making a purchase, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Store.
1. DEFINITIONS
Consumer - a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity, within the meaning of Article 22 of the Polish Civil Code. These Terms also apply to natural persons conducting business activity if the contract is not of a professional nature for them.
Seller - ToBeTheLight.
2. CONCLUSION OF THE SALES CONTRACT
The presentation of products in the Store constitutes an invitation to submit an offer within the meaning of Article 71 of the Polish Civil Code.
To place an order, the Consumer adds selected products to the shopping cart and completes the order form. The Consumer may modify the order before final submission.
Submitting an order constitutes an offer to purchase the products.
After placing an order, the Consumer will receive an automatic email confirming receipt of the order. This confirmation does not constitute acceptance of the offer.
The sales contract is concluded only after the Seller confirms acceptance of the order by sending a separate email confirming that the order has been accepted for processing.
3. LANGUAGE AND RECORDING OF THE CONTRACT
The sales contract may be concluded in English or Polish.
The content of the contract is not stored by the Seller.
4. PRODUCTS
All products offered in the Store are handmade or created in small batches.
We make every effort to present products accurately. However, due to the handmade nature of the products and differences in display settings, slight variations in color, texture or appearance may occur. Such variations do not constitute a defect.
Product descriptions, prices and availability may change at any time without prior notice.
5. PRICES AND PAYMENTS
All base prices in the Store are set in EUR and include VAT unless explicitly stated otherwise. For the Customer’s convenience, prices may be displayed in another currency depending on the Customer’s country or location. Currency conversion and localized price display are handled automatically by Shopify Payments.
Payments are processed via Shopify Payments, which automatically:
- displays prices in the currency appropriate to the Customer’s country,
- offers payment methods available and commonly used in the Customer’s country,
- processes payments in accordance with local payment standards.
The Seller may require full prepayment of the order before processing begins.
6. DELIVERY
Products are delivered exclusively by courier or postal services.
Delivery costs and available shipping options are indicated during checkout.
Delivery times are estimates only and may vary depending on the carrier and destination.
In consumer sales, the risk of accidental loss or damage passes to the Consumer only upon physical delivery of the goods to the Consumer.
7. RIGHT OF WITHDRAWAL
Consumers have the statutory right to withdraw from the contract within 14 days of receiving the goods, without giving any reason, in accordance with applicable law.
The right of withdrawal does not apply to products made to the Consumer’s individual specifications or clearly personalized, in accordance with Article 38 of the Polish Act on Consumer Rights.

8. COMPLAINTS AND CONFORMITY OF GOODS
The Seller is obliged to deliver goods in conformity with the contract.
The Seller is liable for lack of conformity of the goods revealed within 2 years from delivery, unless a longer period is specified.
In case of non-conformity, the Consumer has the rights provided for in Chapter 5a of the Polish Act on Consumer Rights, including the right to repair, replacement, price reduction or withdrawal from the contract.

9. DAMAGE DURING TRANSPORT
If the goods are delivered with visible transport damage, the Consumer is encouraged to report this to the carrier and notify the Seller as soon as possible. This does not affect the Consumer’s statutory rights.
10. ELECTRONIC SERVICES
To use the Store, the Consumer must have a device with internet access, an updated web browser, and an active email account.
The Consumer agrees to use the Store in compliance with applicable law and good practices and not to provide unlawful content.
11. INTELLECTUAL PROPERTY
All content of the Store, including text, images, graphics, logos and designs, is the property of ToBeTheLight or its licensors and is protected by copyright and trademark laws.
Content may be used solely for personal, non-commercial purposes.
12. OUT-OF-COURT DISPUTE RESOLUTION
Consumers may use out-of-court dispute resolution methods, including mediation and arbitration, in accordance with Polish and EU regulations.

13. GOVERNING LAW
These Terms are governed by Polish law.
Any disputes shall be subject to the jurisdiction of Polish courts.
14. FINAL PROVISIONS
These Terms do not exclude or limit any Consumer rights granted by mandatory provisions of law.
If any provision of these Terms is found invalid, the remaining provisions shall remain in force.
The Seller reserves the right to amend these Terms. The current version will always be published on the Store website.
